I'm sorry I said it WAS 3.1.3 now it's on iOS 4! can jailbreak it with iOS 4? or downgrade my 3GS?

I've an iPhone 3gs that I just got on the 18th of May, it has never been jailbroken, and it was 3.1.3, when I got it as a replacement from Apple store, for my old iPhone 3gs. Is there anyway I could jailbreak it and unlock it? or maybe downgrade it then jailbreak it.

Please advise on how to solve this?!! I'll be out of the states for three months so I'm desperate need for my iPhone :(
