It should be noted that until a person is convicted, they are presumed to be innocent. Until a person is charged, and later proven guilty,
then they have the right to due process of law. When we deny those Rights to one, we will eventually deny them to all..

The NDAA does several things unconstitutionally. First, yet legislatively, it does away with the Posse Comitatus Act. Then it nullifies the common law right to Habeas Corpus.
Then it essentially eliminates the 4th, 5th, 6th and possibly the 8th Amendment to the Constitution.
Amendment IV
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures,
Amendment V
No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury,
nor be deprived of life, liberty, or property, without due process of law;
Amendment VI
In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial,
Amendment VIII
Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.
