In this situation, they are not in his life. He bought into this with full knowledge. No one is stopping him from putting one up on a piece of land which has no prior 'bought and paid for' restrictions on it.
A BUSINESS was the WHOLE IDEA!! THE question and the debate isn't weather Zip lines are a good idea or great fun!! No doubt that they are. The question is weather they are allowed on that piece of property. Which clearly they are not, but he didn't like that limitation so he did what he wanted without asking for permission. Keep it in perspective PEOPLE!! Going off on irrelavent tangents only confuses the facts for everyone and he knows it!! IT is by his use of these 'RED HERRINGS" that he will eventually make it happen. Essentially getting away with special treatment only giving him more fuel to his fire.... which is that he is exempt from laws and rules. His fight is costing YOU AND I.
very good point and when I pulled up that info online from Skamania County, he is indeed paying very little in property taxes. ( Land deemed forest service use) Either way, he needs to abide by the limitations and restrictions of the land he purchased as well as get permits before starting such a project.... certainly don[t come crying to the public for the approval when they don't understand the facts and he didn[t even seek approval appropriately in the first place via permits!
His offer to put in a public parking area for his zip line park is only to be expected if people are to have a safe place to park while using the zip lines.... Is that "OFFER" suppose to be some sort of generous and cooperative gesture on his part?? LOL!!
if it doesn't fly it clearly won't be the first time he's made bad business decisions nor the first time he didn't take NO for an answer!
Rumor is he'll now be trying to pass it by saying it is a U-Pick pine cone Farm!!
I so agree with you Tannin! Special rights are what he is asking for.
On the other hand, the county has legal obligations if they allow it. This whole fight is also costing the county and the government: YOU AND I, lots of money. He has everything to gain by the fight and not much to lose. He claims he has 1/2 a million into the project. That 1/2 a million is the cost of the land.
THe sheer obnoxiousness of it is no different than you purchasing a parcel that has CC&R's placed on that you insisit on ignoring when you go to build your home. Or the sheer stupidity of purchasing a piece of land with residential zoning regulations on it with the intentions of putting up a restaurant and then trying to get away with putting up the restaurant and saying it's ok because everyone would like to have a restaurant in the neighborhood.
Nothing was changed after he purchased the property. In 1995 the forest service purchased an easement across the bulk of the land for the purpose of retaining the land as agricultural, giving it certain limitations that went with the land forever. That cost the government: YOU AND I, $450,000. Now HOyte wants to use that easement for personal gain. He knew full well the limitations when he purchased it in 2005. NO one twisted his arm to buy it. He took a gamble buying it and by putting up a zip line park without getting permits. It might have been a smart gamble as he knew how much people would like to have such a recreational opportunity in the gorge.
THe owners who sold the right to the forest service were well paid. The property was bought and paid for by the government, and the owners turned around and sold it again to Hoyte. Hoyte knew the limitations. He bought it anyway. He just figured the limitations didn't apply to him.... would you do something so stupid and devious and then beg for support for your stupidity and deviousness? Everyone is so eager to jump on their own personal bandwagon and don't even acknowledge or know the facts of the situation!
You all fail to acknowledge the fact that he knew the limitations of the property when he purchased it 3 years ago and pursued the idea anyway to the point of putting it up without FIRST getting permits to do so. IT was not the reason he purchased the property. The idea came later. And yeah, sure it's a great idea but that doesn't mean he should have the right to carry out his grand idea in any manner he sees fit. Having grand ideas doesn't give one cart blanche liberty to do what they want regardless of laws, regulations or limitations. This man simply doesn't accept the word NO in any situation and is constantly pushing the boundaries, limits, and laws in our society in the pursuit of Money.
with no insurance coverage? he has nothing to lose if the zip line fails and you die! But then that's life!
Oh he is well versed in Real estate, having purchased much property in the county...as well as trying to purchase 1/2 of waldport with false promises and gradiose ideas. He knew full well the restrictions on the land but didn't care and did this knowing full well it wasn't allowed, thus why he did not pursue the permits which would alert the county to the goings on.... he is as shrewd as they get.
