I doubt they have or will offer him a deal. He's already in for life. A plea deal does nothing but add more paperwork and wastes time and money.

No, going for the death penalty is the only possible action that can have any negative consequences for him. Once they have enough solid evidence, my money is on them going for it.

Companies can, to a point. Problem is you get into ADA protection if their obesity is considered a disability.

It's really apples and oranges, though. Obesity is the result of unhealthy habits. Smoking is an unhealthy habit in itself. A more comparable situation would be to ban employees from eating unhealthy food even at home.

Which would be allowable, funny enough.

They can decide their own hiring practices, including what you do in your off time, as long as they do not base their decision on being a part of a protected class. They can ban people that snowboard, if they so chose.

If the rule is "you have to clear a nicotine test" then you have no defense, e-cig or not. It's thier right to decide their own hiring practices.
