So, if I'm this guy's lawyer, I'd start with "prove that it's my client operating the motorcycle from the view you get of the rider in the video please." Hmmm, can't prove it's him? Tough luck then. Clearly the guy was and is an idiot, but even idiots have legal rights. If they don't have proof it was him, then they can't convict him. It's called the Rule of Law.
