It's always nice to win, but we should never have been put through this ordeal.
They have the cops ticket people at a violation level, so that an attorney won't be appointed to those who can't afford one. There is scant info on how to proceed on one's own behalf, and the fees sure do pile up, and no info on how one might try to get it all back..

It appears they have been at this for quite awhile.
Since they will not appoint an attorney to help citizens accused of traffic offenses, it makes it hard to gather accurate info on how to proceed. The info is not readily available to the public. When my appeal was filed, I requested discovery, and that the court appoint an attorney to assist me in my defense. A judge didn't rule on the attorney request. The gal at the window simply said , that they don't appoint attorneys for traffic offenses. I shall plod on though. If I actually get a hearing this time, I am confident I shall prevail!
The publicity was a side effect, of getting video evidence to refute what the cops have. What's happened since has made things even better. Gotta love that long pause when Ms. Harrington asked. " Then why did he get the ticket?" . LOL!!

I plead Not Guilty, October 14. On November 13, (yes Friday the 13th), rather than assign a court date as promised, the judge rendered a decision of guilty. I was never given the opportunity to plead my case.

I am hoping to make it so there is no next time. There is a simple solution,
and I will try to get ODOT to consider it.
I have asked via information request, for any info on the intersections in question, and if possible work orders for adjusting the timing. The timing has changed since Ms. Harrington's first report.
Has everyone seen the local paper's rendition of the issue?

The Albany Democrat Herald led me on for over a week about doing this story, and helping me with video evidence. On Wednesday I was told they would not be doing the story at all.

They are saying the police told them, that I led Elissa, to use "the wrong light" in the story..

These folks did not see the dash-cam video. I did.

I guess if you like them, you will believe they have the story right.
They claim the police told them it was the wrong light. I did show them the right one though lol.
Unless the video has been altered, (and seriously, I doubt that happened),
the police misled the democrat herald, to try to make this go away, as easily as
I was supposed to when I got the verdict by mail.

Only a few people have seen the dash-cam video. I was one who actually did.
These people have done a real hit job on me, and KVAL, based on hear-say.
I can understand how they may have been embarrassed by being scooped. They did leave me in the lurch though.
KVAL asked for the video, and were given the excuse that since I was intending to appeal, they couldn't show them. I did and continue to give, consent.

So, what would be the harm, of having both lights be red at the same time? lol
I mean geeze! (yes in addition to "by golly" I also use "geeze")
I have seen intersections in other parts of the country, where all the lights at an intersection are red for 20 or 30 seconds.
I went to file my appeal according to the paperwork provided to me by Albany Municipal Court. I was told to wait. I waited a good 6 minutes, then the gal who showed me the dash-cam "evidence", came out and informed me that she had called the county clerk, and had been advised that the $189.00 on the paperwork they gave me, was obsolete, and that an additional $8.00 was required to file my appeal. I dug out my last 20, and was given the proper amount of change. This is another example of how chaotic it is down there!

I have not appeared at a second court hearing, I was found guilty, though a court date was never set. I have video evidence (see above); that only people watching KVAL last night and this morning, or saw the video on this page, have seen the evidence. I suppose I could demand to be heard by this same judge, but um, I figure he had his shot at it, and took it.
If you want an explanation as to how this can happen in the USA, you will have to ask someone who was in on that decision making process. I hope it will be explained during the appeals process.

I'm the guy in the video.
It's amazing how they made me look like an old fat guy. lol
I digress..
I believe it is the duty of every citizen to point out things that are wrong, or unfair, and hopefully make improvements.
This is how our way of life, can get even better.
I am a Gad Fly extraordinaire, and am not ashamed to be so.
I do not believe I am being treated differently than anyone else.
What is wrong with this traffic ticket, and subsequent related events, is not getting the hearing we all are really entitled to, in America.
By standing up for ourselves, we stand up for one another.
I was being rhetorical in the film, but I am committed to being cleared of committing this offense, and hopefully in the process, making things more fair for others.
It is what it is, and it will take what it will take.
