Before FDR was president, the courts adhered to a theory of substantive due process of law where the state could not force a contract upon a person nor impair their ability to make a contract with another person. State laws restricting the hours you could work, what you could agree to do at work, what rights you could sign away, and whether you could be forced to join a union, or be forced to agree not to join a union, were illegal under the due process clause. This was one of the reasons the New Deal had problems passing at first, before FDR threatened to fundamentally alter the supreme court and have justices thrown out for being "senile". The old substantive due process era was know as the Lochner era (based on the case Lochner v. New York). I say, bring the Lochner era back and bring back the protections where a union or government could not force you to join a union or engage in any contract (including mandatory health insurance a la Obamacare) without your individual consent.
I dont think Congress can do this. The private companies that buy these student loans have 1. A valid contract with whoever sold it to them and 2. With the student that owes the loan. Congress cannot just swoop in and change the terms of the contract, this is tantamount to seizing property, for which the companies that own the student loans would be entitled to just compensation. EDIT: Congress could, however, simply make the contracts illegal as is and force the companies to pare them down or risk losing the entire amount due under the contract....but this is questionable and Constitutionally offensive.
I was playing devil's advocate, not espousing my own beliefs. And yes 9-1 is a good estimate. The top 1% of income distribution in the United States control about 35% of the total private wealth. The top 20% control 85% of private wealth. Combine that with the fact that 50% of Americans no longer pay taxes and my subjective belief that the will of people to work hard for what they want has diminished, and the hard working people of America are faced with the real democratic problem of having all of their money voted out of their hands.

This is the problem with democracy. This guy doesnt have to justify things past "Because its my opinion" because the majority rules in a democratic system. The so-called 99% dont need a reason, justification, moral standpoint, or any other explanation in order to deprive hard working Americans of their money. We need a new constitution that establishes minimum qualification before you are allowed to cast a vote. Starting with, let's say, actually paying income taxes. No voting unless you have skin in the game.
No you dont, and nothing will happen to these officers. It will blow over just like every other police beating or murder. They are laughing in our collective faces. There needs to be a constitutional change where a 4th branch of constitutional fundamentalist officers with their own delegated power come in and administer justice to those in police and government who are supposed to be doing just that, but have used their power to escape punishment themselves.
When a gang beats an individual up, there is a criminal investigation with all the power of a prosecutor, judge, jury, and criminal justice system behind it. When a gang of cops beats an individual up, there is an internal investigation within the police department. Realistically, this investigation is done by another union member, colleague, and possibly even friend of the gang of officers in question.
What happened to equal protection of the law? Since when do cops get a separate, sham system of having their crimes investigated?
This is why we need a 4th branch of government to come in with the power to arrest police officers and administer real justice, just like what happens to every other criminal in our country.
Only people who actually pay income taxes should be allowed to vote. This is the problem with democracy, the lazy and stupid figure out they can vote themselves other peoples' money, and there will always be some opportunistic piece of garbage politician willing to sell his soul for a position of power who would be more than happy to run on platform suggesting he will do just that. Barry Obama, thank you for making me right.
