So ACTA shouldn't theoretically be able to break French Constitution. (and therefore 1789’s Declaration of the Rights of Man and of the Citizen)
But it could indeed be very dangerous without breaking it. (extend time before public domain, promote three-strike rule, re-enforce DRM-likes, etc.)
What scares me the most is net filtering : I’m not sure institutions like the Conseil Constitutionnel will understand the fact that it’s the highway to extinguish democracy…
