This was a justifiable homicide. Another "good boy" that breaks into occupied homes, robs and rapes. I wonder how many other crimes this clears up? I guess the woman he attacked has now learned that when seconds count, 9-1-1 is only minutes (or hours) away.

First rule change for the House when the session starts; Any member absent without the approval of the House for 2 days shall be considered to have abandoned the seat and will be replaced by the Govenor to complete the term of the individual replaced.

It's either that or we put ankle monitors on a few of the democrats. Since they are going to lose every vote, they might all just move out of state until the Legislature is over.

Acevedo is kool with illegals driving around without a license or insurance, DWI and wrecking others. But NO! Don't "profile" these illegals. Sanctuary city anyone? But he has a hard one for this guy. "Attempting to take a ring off her finger and I don't want him on my police force"? Acevedo needs to go BACK TO KALIFORNIA!

The "Bush tax cuts that only benefited the rich" were also inclusive of the "little people". To wit, the 10% tax rate goes away and the now newly "rich" po folks will have a 15% tax burden. And every other tax rate goes up also. I don't know how this will affect the "earned income" tax that pays people that don't make "enough" money. I don't know why conservatives aren't making this point now.

You have to assume that "halt or I will call the cops" didn't work. The THEIF did not put down the property when he got out of the store and it doesn't matter if he was "off the property". This mailer wouldn't let me put all of the Penal Code Section 9 up, so you'll just have to look it up if you want more info. I doubt the grand jury will indict for murder. Maybe obstruction of justice.

Sec. 9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is justified in using deadly force against another to protect land or tangible, movable property:
(2) when and to the degree he reasonably believes the deadly force is immediately necessary:
(B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property; and

(3) he reasonably believes that:

(A) the land or property cannot be protected or recovered by any other means; or

(B) the use of force other than deadly force to protect or recover the land or property would expose the actor or another to a substantial risk of death or serious bodily injury.

This occured during the "nighttime" and thus, the amount of theft does not matter. Now there may be some other issues if he removed evidence, but that doesn't make it murder.

Why is this guy charged with a crime? Unless the Austin POlice dept. can "make up" law on the spot, this guy is JUSTIFIED in using deadly force. It's a shame that the "new" DA is still acting as stooge for Ronnie Earle.
