I did not say I was in favor of the death penalty at all. I simply stated that the offense is punishable by death in the state of Indiana because it meets criteria. I hope that it isnt even considered. I said that from a legal standpoint, they would be fortunate to get only the maximum sentence.
I aplaud the Superior Court Judge for making the decision to put these boys in the adult system. I understand that it is hard for the general public to hear something of this magnitude. I doubt it will happen because of the age of these boys but I believe it is important to note for the public that had this been committed by a non-waived adult, the death penalty in this case would be a possibility. These kids had a plan and determination to do this. They planned the trip, the weapons to use, where to escape to, and most importantly they LAID IN WAIT. They premeditated this murder and waited in that house until they had the opportunity to commit the murder. In the state of Indiana that is punishable by death. These boys would be "lucky" legally speaking, to only get 65 years in prison.

As for everyone saying they should not be in adult jail or prison because of what will happen to them. Procedures are put in place in these circumstances, because they do happen more often then people like to believe! They will be kept seperate from everyone in the jail and trasported to and from court seperately, shower seperately, live completely seperate. If found guilty and sentenced to lets say 50 yrs. in prison. They will be sent to a state juvenile correctional facility until they reach the age of 18. They will then be transfered to adult prison. Things are set in place such as this because it has been needed before. This isnt the first time and it wont be the last that young children have done such horrid things. It seems like everyone is forgetting the most important thing. THESE KIDS TOOK ANOTHER PERSONS LIFE IN COLD BLOOD! Its not about the kids just being kids anymore. You want to play like a criminal then you better be prepared to face the judge that will decide the rest of you life because of it.
I can understand the shock to the community and to the families to hear that a 15 and 12 year old boy that they care about and want to believe could never do such a thing. However, these boys committed one of the worst crimes against a person possible. These boys had lookouts which means that they knew they were doing something they shouldnt be doing, they had prepped weapons to use in the crime, and they had a plan to "escape" and go to Arizona. If anyone over the age of 18 would have committed this crime everyone would be screaming for the death penalty. The boys age alone can not be the only factor in a case such as this. The judge made the right call, which im sure was quite difficult for him to be put in a situation were you have to do such a thing. The fact of the matter is though that these boys knew exactly what they were doing and need to pay for it dearly.

I love the people who are responding and only paying attention to the first 5 lines or so of the story. "Since when is dancing a crime". If you would clear your mind from judgement against the police for a few seconds you would see the facts. The girl was told to sit and be quiet several times. Then told to go to the office area. She was arrested for commiting BATTERY, not dancing. At 15 you are well aware that you cannot kick a police officer. And if an officer or just an adult for that matter, makes a reasonable request of you, such as you need to sit back down because you are disrupting school, you listen! If you dont, at 15 you should face the consequences just like everyone else. If she was an adult and an officer told her to do something and she chose not too...she would be handled like an adult and made to do it weather she wanted or not, not just asked to go to the office. Such disrespect for the police from the children and their parents. I would love them to do our job for just one day and see how difficult it is with no appreciation.
I have recieved many hours in training with application of the TASER and have indeed been tased myself. If the TASER was a device that had I high potential of causing sudden death, it would not be used by over 13,000 law enforcement agencies. I also believe your referring to ventricular arrythmia, which causes sudden death. Any time this has been brough up by family as the cause of death it has been proven wrong by medical examiners. Ventricular arrythmia would cause death within minutes, not hours such as this case and all the others that have claimed this. The TASER also does not interupt your "electrical cycle". It matches your rythem to specifically not cause this issue and has proven so through thousands of applications with a TASER caused death never proven. With drugs in his system it is likely he entered a state of excited delirium which is a medical emergency. In this state subjects are impervious to pain and have super human strength. The officers did exactly as they are trained, waited for backup, used the taser to avoid unneccesary injury, and gave him medical attention as soon as possible. This is a common cause of subject in police custody, hoped up on dope, and agitated.
For one this young man had many issues that he needed to be on medication for. If he was off of his meds that would explain alot of this. It sounds like a possible case of excited delirium to me. Also, Kentucky1, the TASER will not affect your heart. You could use a TASER on someone with a pacemaker with no ill effects resulting from the TASER device. It does not deliver an "electric shock", it simply stimulates the muscles and makes them rigid to stop you from being able to fight. It does not increase your heart rate, raise your blood pressure, nothing of the sort. I wish people would do their research on specifics and become educated in what they are complaining about before they start complaining about it.
