States Rights & the MADE IN MT, TN, TX, UT Act PART 2

here is the Glenn Beck link-

http://www.youtube.com/watch?v=W_Lv0Nfvkvo

• What this boils down to is States Rights. The Federal Government, Congress, has used their "interpretation" of the Interstate Commerce Act to push much of the progressive agenda through. I believe this really turned during the FDR Administration.

"Congress shall regulate commerce among the several states"

• What was suppose to open trade has been used to govern states and push agendas, as mentioned above. This happened in the 30s on a case about a Farmer growing his crops and taxation. It is called "United States v. Butler, et al."

Here is that link (be sure to read it down past the middle): http://www.answers.com/topic/united-states-v-butl...

• Here is the meat of what MT, TN, TX and Utah are trying to do.

If a weapon and ammunition is made in TN, sold in TN and used in TN then the Federal Government has no jurisdiction over this matter. The reason given is it is not used in "interstate commerce"

TN is pushing it too. HB 1796 by *West, Fincher. (*SB 1610 by *Beavers.)

Firearms and Ammunition - As introduced, enacts the "Tennessee Firearms Freedom Act." - Amends TCA Title 4.

Here is a link for their info:

http://wapp.capitol.tn.gov/apps/BillInfo/Default....

Utah (Carl Wimmer-R) is trying to get what they call a "Patrick Henry Caucus" started to have their legislators fight back and assert state rights. They are using it in conjunction with this to force the Feds hand.

TX (Leo Berman-R) is proposing what MT has and has proposed HCR 50 to reassert their state sovereignty.

MT (The governor is a D but I believe the LT Gov is an R) has already signed it and it goes in effect on October 10th, 2009

In MT they are already set to appeal it. The attempt is for enough states to pass this, then appeal it, to force the Supreme Court to rule ASAP. Doing so before another crazy liberal judge gets in.

As Judge Andrew Napalitano says and I paraphrase "This would shrink the ability of the Federal Government, Congress back to the days of our Founders."

Also, he stated that about 90% of the progressive agenda passed through this method would go away.

• Here are some links for the 10th Amendment and some info. What I know of the 10th is that slowly our state rights have been slipping away.

" 10th Amendment

"The States should be left to do whatever they can do as well as the federal government"
Thomas Jefferson

"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."

One of the most contentious points in the formation of a Federal government came from the individual states. The states didn't want to lose the ability to make regional decisions nor to be subject to an overriding power from a distant national capital. The Tenth Amendment was written to reassure the states that they would remain largely in charge within their own borders. Until the mid-19th century, the Tenth Amendment was often cited by state governments to prevent Federal regulation of everything from taxation to interstate commerce. Since 1837, however, various rulings have mitigated the straightforward meaning of the Tenth Amendment, and such matters as a Federal income tax were subsequently upheld in the courts."

From my blog-

States Rights & the MADE IN MT, TN, TX, UT Act PART !
May 10th, 2009

Before we get to the information below we should ask ourselves the question “why?” Why is this even transpiring in the year 2009? Why would average American citizens, most whom are the backbone of this country’s working class, tune in and activate their lives at this moment?

While it is simple to blame the current Administration for their heavy handed charge toward what many believe to be Fascism, we should take a closer look at the last 100 years.

Did you know the Socialist movement has been around in this country almost as long as we have been here?

Did you know FDR put much of this in place and that Teddy, and “Woody” Wilson played important roles in the “Progressive” movement of today?

Did you really think to consider what former President Bush meant by being a “Compassionate Conservative?”

You see this has been moving in said direction ever since we were founded. It has sloshed up and down like the rocking of a boat, or the pendulum of our country and only recently has it awakened the conservative masses. Maybe it is the pace at which this administration has moved. Possibly it is the availability of the internet where “your” news may be found with a single click of a mouse. Or it could be a combination of these items in conjunction with the people actually learning what their Founding Fathers really stood for. If the latter is a part then we should thank the author of “The 5000 Year Leap” for his contribution. If you have not read it, then you are most likely mistaken with what you “know” of our country, faith and our foundation.
