The fact that it is not applied equitably should be an argument.
The unconstitutional argument is almost he same as the unequitable. You can make the argument that it is cruel and unusual, but since they killed people in 1783 it is hard to argue that the writers of the Constitution didn't understand capital punishment. It might be cruel, but it has never been unusual.

But the argument that we have not found humane ways to kill people is only true if there are no ways to kill people.
The guillotine is actually fairly humane, except for the fact that the accused knows that he is being led to his death. It is very quick, much better than the electric chair or death by drugs.
The method of killing should not be used as an argument against the death penalty.
