Do you have an enumerated Constitutional right to transfer an unlimited amount of property to your spouse without being subject to gift tax (or estate tax upon death)? Are you constitutionally guaranteed visitation rights to see your spouse in the hospital? The right to make emergency medical decisions on behalf of that spouse? To file a joint tax return and get a larger exemption? The right to refuse to testify against your spouse in a court of law? None of these rights are enumerated in the Constitution; are they conferred by the Catholic Church then? These rights (heck call them privileges if it makes you feel better) are benefits given by the state (generic use of the term) to recognized married couples. How about we take these rights (and all the others) away from everyone unless and until you enter into the proper contract within your jurisdiction? You can only enter into this agreement with one person at a time, and that person must be of legal age to enter into an enforceable contract. The churches, temples, mosques, etc., can do whatever they want, but it doesn't confer the civil rights that the state does. Problem solved?
