"A person born out of the jurisdiction of the United States can only become a citizen by being naturalized...by authority of Congress...as in the enactments conferring citizenship upon foreign-born children of citizens"
That exactly describes Ted Cruz's status. He is a naturalized citizen according to the Supreme Court of the United States. He is a foreign-born child of an American citizen.

Judge Jeff S. Masin essentially said this is a legal issue, not a political issue. It is not frivolous and ultimately the US Supreme Court needs to decide this.
