No rights are absolute. For example, if Charter rights were inviolable, we wouldn't incarcerate criminals (s.7. right to liberty). It's the same principle that limits your freedom of speech to prevent you from falsely crying fire in a crowded theatre. The Court approached this in 1986 by creating a four-step test (see R. v. Oakes) that establishes the requirements that must be met before a government--notice the onus of justifying the violation is on the limiting party--can limit rights.

It's a sad reflection on our politics when being a human rights professor is somehow considered a demeaning profession. There are several reasonable arguments as to why Ignatieff might be unfit to lead the country, but that he taught at Harvard is certainly not one of them.

I wonder how much of the idiocy displayed by Clement over the last couple of days is just the minister following orders to defend the new policy, against his own better judgement. Haroon Siddiqui reported over on the TorStar that the directive came straight from the PMO, against the advice of both Clement and Jim Flaherty.

There's nothing wrong with cranky old white males loving other cranky old white males. That's why we legalised same-sex marriage back in 2005!

Jokes aside, I am willing to give the Prime Minister the benefit of the doubt with this appointment. If we are going to play the grieved minority game, then surely the subset of our population who are most clearly overdue representation at the viceregal level are First Nations peoples. However, I also believe that bilingualism is de rigueur for any prospective Governor General, and all the potential aboriginal GGs whose names were tossed around failed that very crucial requirement.
