OUCH!!! I'm down to a -1 already? Where are all the hunting advocates? Not just that, but what about the simple fact that this man got to do something he cherishes with his kids one last time before cancer takes him? No matter how you feel about hunting, have a heart for a terminally ill man. Geez.

KATU - Portland, OR : Portland\'s mounted patrol saved by $100,000 donation | City Center News

Your radar detector that detects 3 different types of radar won't do you a bit of good when a cop's lidar (aka laser) can get a speed reading on your vehicle in under a second (which is far quicker than the time it would take you to acknowledge any radar/lidar detector going off, then reacting to it by braking, and getting your car to slow down enough to make a difference). Your luck will run out. Let's hope it's by just getting a ticket and not by hitting and killing someone. Speed is the #1 cause of traffic fatalities (by a large margin). And Trapster only works when the people in front of you report the speed trap. There isn't a magical "cop detector" that automatically posts their locations.

KATU - Portland, OR : Court rules against DUI cyclist facing 3-strikes penalty | KATU.com - Portland News, Sports, Traffic

part 2.... 3) "does that mean if the man is drunk and pushing his bike home that he can be jailed as a habitual offender?" -- No. There is no law called "habitual offender." Your license can be revoked for being a habitual traffic offender, but in response to that, see above. 4) "If all vehicles are the same then why can't cars drive on bike lanes and sidewalks?" Because although the law doesn't differentiate between motor and non-motor vehicle for DUII, it does for most other laws, and there are laws that prohibit operating motor vehicles on bike lanes, bike paths, sidewalks, etc.

I'll have to split this into two comments because it won't let me post the whole thing, but here are some clarifications and corrections to your questions/statements: 1) "This law only applies if one was riding on the street. If he were riding on the sidewalk then it would just be drunk and disorderly." Incorrect. A sidewalk is considered a "premise open to the public" and DUII is enforceable on any premise open to the public. That also includes parking lots, parks, or any other place that the public is generally allowed to travel. 2) No, they won't cite him for driving w/o a license (or more properly Driving While Revoked) because ORS 811.182 requires the person to be operating a motor vehicle.

Your driver license is for operating "motor vehicles," but you can be convicted of DUII for operating ANY vehicle, including bikes, skateboards, etc. The appellate court is required to uphold the wording of the law, not to interpret what the legislature may have intended when the law was written. The law says that, under a conviction for a 3rd DUII, DMV/court must order a permanent revocation of the person's driving privileges. The law does not differentiate between DUII in a motor vehicle and DUII on any non-motorized vehicle. Therfore, when this person was convicted of his 3rd DUII, his license was properly revoked, even though the DUII conviction was from operating a bicycle.

Why? If that's what it costs to keep his "privilege", then that's what it costs. You don't just have the right to drive forever once you get your license, and your license is property of DMV--they can cancel it or choose not to renew it if you don't follow their rules. Plain and simple. And he can be just as much a contributing member of society by riding Tri-Met. The fact that he is a veteran is more than honorable; however, it has nothing to do with his ability to renew his license.

It's not "unforseen" when DMV specifically tells people not to wait until their license is close to expiring, just in case these problems arise.
