Can it be negligent homicide when the actions are willful and the deaths foreseeable? Off the top of my head, the felony murder rule seems a more appropriate charge.

Ummm...does this guy understand that a lawyer's job is to interpret the law, not to make it? If he doesn't like what is legal, then the problem is with the lawmakers, not the lawyers.
