You don't need to be concerned; there was a bug in the first release where the latest iPod Touch firmware wasn't being recognised. This has been fixed. No other changes are in this second release.

He won't be able to just cancel the account - Google have to protect themselves legally also, which is why the DMCA notice is the only possible way these things get done.

Realistically it won't help though, and is a bit petty. Your best chance at making any dent in sales is by serving DMCA notices to Google's Search department to remove his site from the search engine, and a secondary DMCA notice to Google's AdSense department to cancel his account there. http://www.google.com/dmca.html and http://www.google.com/adsense_dmca.html

This is the way to go. DMCA notices will remove him from Google search results and adsense etc. and sufficient proof is available.
