No, I'm thinking of Linhardt suing his own attorneys.

Judge Posner was quite clear that there are likely no damages, but it was still Linhardt's burden to show that there was some basis in fact for an award of any amount. Guiding Linhardt through that bit was the job of his attorneys, but they not only completely failed to do so, but completely failed to do so in a way that Judge Posner found not only incompetent, but "grotesque."

I think that we must listen to what customers say. When we stop listening to what they say and start assuming things that run counter to what they tell us because we THINK that their actions say something different, then we need to stop pretending that we respect our recipients at all.

While all analogies are poor, when we get to this point then we stand pretty much in the same place as the man on trial for sexual assault whose defense is "She said, 'No,' but her body language said 'YES!'" It's disrespectful to say that we can disregard what you're saying because of how you're acting or how you look.

I'm also wondering if Facebook will provide a way for folks to monitor where their messages go so that they can do things like remove people who deprioritize them.

Yes, it is true that they see lots of address churn. However, I think that one of the things that people like about them is the ease with which new accounts are created. Churn, at least, here does not necessarily translate to lost users.

This is so important for people to know. Doing email marketing right is about constant evaluation. If you can't figure out why people are not engaged by your efforts then you are doing something wrong.

Testing is the only way to see if your strategy is a good one. Some tests are easy to do, some are hard, but you cannot let inertia dictate any part of your marketing efforts.
