Berkey and Propur water purification filtration systems are really, really good products. I believe everyone should have one. They are the perfect, portable survival water systems. Hurricanes, storms, earthquakes, civil unrest, you name it…. any of these types of disasters can pollute the already polluted city drinking water in your city or town. I don't have any specific interaction with them. I'll just say that there are maybe a half a dozen of us anywhere in the country who really know how to audit these transactions from all angles and can work with and/or coach an attorney through the process to bring these claims. To rescind this loan you will have to use your state statutes to bring a claim for rescission. You only have three years from the date of consummation under the Truth in Lending Act to rescind for material disclosure violations. The three years is a hard and fast date. No wiggle room on that. Fraud in the inducement or something similar, if it can be proven, may be a viable option to rescind or cancel the loan. This is a question for a good litigating contract attorney.

You will have to go on the offense to bring a fraudulent claim against any and all parties related to the loan. Fraud in the Inducement or Fraudulent Misrepresentation are probably the best routes to take. Be advised that a fraud claim MUST be plead with specificity. General allegations won't fly when making a claim for fraud. You have to have evidence and be very specific if you are going to use fraud. This might be a case for an expert loan auditor and attorney to work on. This is what I do and I work with many different attorneys.

Jen - the July 20, 2006 date is the only date that can be used for calculating the various statutes of limitations (SOL) as it applies to the Truth in Lending Act. The act uses the "date of consummation" as the date for calculating SOL issues. Any TIL violations you or an auditor that is hired to audit your loan file can be used as "claims in defense by recoupment" as there is no SOL for violations used as Claims in Defense by Recoupment.
