I guess that is the point I was trying to make. That when we talk about ethics, we really need to think about from where we are deriving our ethical perimeters. If the state is permitted to surveil for the purpose of safety, why can't we for the purpose of art?
Here is what I suspect:
You actually did record that man in the subway and and are sparking this debate as a litmus to test the ethical implications of your having done so. Or maybe I am wrong. But I ask this: Why is it ethical to look away? Why is it clear cut that we are to look away when in doubt of the appropriateness of staring? Is it our strong ethical convictions that cause us to avoid eye contact with crazy people on the subway, or is it our desire to simply not engage in the scene due to our concern for our own safety, as well as fear of being labeled part of the scene by others who are themselves looking away?

I really like what you are doing with these Artworks. The idea of creating small snippets of soundscapes which are to be taken in as one would a photograph is a refreshing use of audio-for-art. By that I mean, most artnoise that I have encountered is either linked to larger installations that depend on being present in a gallery space and often try to affect some sort of ambiance. Other forms of artnoise are sometimes too long and mish-mashed and cut and edited together...which often dilutes the aesthetic quality of the recordings...However, this short clip attempts none of these things. It is simple and honest and short enough to enjoy without getting annoying. Also it shows so much on its own. Bravo. I would however suggest finding a different word for these pieces other than "sculptures" as sculptures are things which are built or carved or cast...whereas this piece is merely captured.
Keep them coming.
