The whole issue is Babeu's abuse of power which includes alleged threats to deport Orozco. I'm not saying that it might turn out that Orozco is, in fact, a US citizen. But if he is then Babeu just becomes a typical GOP gay sex scandal and not as bad as it's being made out to be at present.

So, it's not exactly a red herring whether or not Orozco is a US citizen. Darby is clowning it up here with his claim.
