As used in this paragraph, &amp;quot;public transit vehicle&amp;quot; has the meaning given that term in ORS 166.116 (Interfering with public transportation);  (e) While being aided by another person actually present, intentionally or knowingly causes physical injury to another;  (f) While committed to a youth correction facility, intentionally or knowingly causes physical injury to another knowing the other person is a staff member of a youth correction facility while the other person is acting in the course of official duty;  (g) Intentionally, knowingly or recklessly causes physical injury to an emergency medical technician, as defined in ORS 682.025 (Definitions), or a paramedic while the emergency medical technician or paramedic is performing official duties;  (h) Being at least 18 years of age, intentionally or knowingly causes physical injury to a child 10 years of age or younger; or  (i) Intentionally, knowingly or recklessly causes, by means other than a motor vehicle, physical injury to the operator of a taxi while the operator is in control of the taxi.  (2)(a) Assault in the third degree is a Class C felony.  (b) Notwithstanding paragraph (a) of this subsection, assault in the third degree under subsection (1)(a) or (b) of this section is a Class B felony if:  (A) The assault resulted from the operation of a motor vehicle; and  (B) The defendant was the driver of the motor vehicle and was driving while under the influence of intoxicants.  (3) As used in this section:  (a) &amp;quot;Staff member&amp;quot; means:  (A) A corrections officer as defined in ORS 181.610 (Definitions for ORS 181.610 to 181.712), a youth correction officer, a Department of Corrections or Oregon Youth Authority staff member or a person employed pursuant to a contract with the department or youth authority to work with, or in the vicinity of, inmates or youth offenders; and  (B) A volunteer authorized by the department, youth authority or other entity in charge of a corrections facility to work with, or in the vicinity of, inmates or youth offenders. <description>In the USA, since the revolution, there is not  criminal libel.  I guess 17 states have some sort of criminal defamation law,  but it is rarely invoked.  On libel, the principle could sue for actual damages.  But parody is a fine and respected defense.  The thing about parody is that the more outrageous and unbelievable it is, the more it is easy to protect.  So the deal is about whether the school should be messing with off-campus not school sponsored events.  On campus, the school has some responsibility for student behavior.  So you might think they have some power there.  But I have not seen school types being sued for something a kid does at home.  Do they *want* to be liable for what kids do at home? </description>

<description>so I have been having a lot of pain.  Indeed I got an offer of lots of opiates, refillable.  So I punted, but I figure I am strung out real soon now anyway.  So if maryjane worked,  and it got past some considerations, I would go for it.  As to working for me, who knows, and it is expensive to go through the hoops.  So I should reasonably turn to the black market for a try.  But I figure it is not reasonable to ingest stuff out of the black market or even the little home grown legal suppliers.  It seems a little odd that for me oxycodone is convenient for me to get and nastily physically addictive is dirt cheap but grass that no  one claims is physically addictive anymore is a problem for me.  There is a fine question as to proper medical use of grass, but how many big double-blind studies have been funded?  This would usually be funded by the feds one way or another.  It has been a long time.  What happened:-)  So maybe my reasoning is not quite right, but something is not working right IMO     </description>

<description>There is that statement that all the residents of the entire apartment building were treated like murder suspects.  And that maybe relative outside walking his dog, getting thrown to the ground.  I wonder if he had any warning, sort of like a disobey a police command thing, or did the cops simply just attack him?  And there comments about irresponsible parents, apparently for living in the same apartment complex as a relative wanted for a crime.  I find it curious that for some people, cops can do no wrong, and for  other people, cops can not do anything at all right.  On the former people, do they really want to make a big defense on Bull Conner?  On the latter people,  do you really always to take the &amp;quot;victim&amp;#039;s&amp;quot; word.  All very peculiar.  But here is something that might make both sides feel better, if they are actually interested in something like the actual events in question.  There is at least one guy walking around Microsoft who is recording permanently everything about his life, including audio and video.  Long term research project.   So right at the moment, there are some limitations, but I doubt anything that would keep cops from being continuously recorded.  Would it give you warm fuzzies  during your next cop interaction?    And pushing it a bit, I have pondered the idea of limiting the civil rights of government employees and elected officials, as for instance cops.  Before you go all freaky, consider the UCMJ.    </description>

People like to throw around identity theft allegations, but I imagine that when he picked up the ID, there was no crime committed.  The identify thief we think of these days is real recent innovasation..   Mostly the violations involving identity are really around fraud and lying to the government.  Is it not amusing that it is legal for Obama to lie to me, but not for me to lie to Obama?  Some history.  After the civil war, lots of people felt the need to disappear.  Pretty much all that required was a horse to go west.  Many people think this was a very significant safety valve for the nation. </description>

<description>So I can look at the old stories on this and talk a little techie.  The original story was a fat fingered trade.  This is the term of art for a typo.  And this wiped out a trillion dollars on multiple continents.   So I am a programmer.  It happens that these things do happen.  But if my software leaves corpses around, my peers are judgemental.  The idea is  that for some classes of software, you should do a particularly good job writing it.  It happens that if you can screw up bad because of fat fingers and such, maybe the user interface and checks and such are not well designed.  And  the reason is going to be a management issue.  If it is bad enough management, we say a phb issue, after a pointy haired boss who is a character in a cartoon &amp;quot;Dilbert&amp;quot;  So when the newspapers say fat-fingers, mostly we think coverup.  Now it happens that the way you deal with anything important and difficult and ill-understood, is that you put in checks and limits redundantly.  This is not simply a software thing, but also a policy thing and even a law thing.  Now, I would say the whole financial monetary system is  melting down.  It needs some decent checks and limits.  IMO, the key vote in this Congress is for the Cantwell-McCain amendment to the Dodd bill in the senate.  It reinstates glass-steagall that got wiped in 1999  by Larry Summers.  It comes from 1933 and had keep things relatively smooth for 60 years.  Essentially, it keeps the necessary and  useful commercial banks out of stock trading, derivatives, and insurance.  So I do not quite think it will come up for a vote Monday, but any day now.  It was debated last week and will continue to be debated next week.  Call your senator.    Obama personally pushed the EU 1.1 trillion euro super-tarp through and made it happen by committing unlimited dollar loans to the european banks.  You do not hear much about it, but bush did the loan committment gig in 2008 and it went over a half trillion.  I expect this time it will be a lot more and it cannot work.  And the Cantwell-McCain amendment is the sole alternative.  When the super-tarp does not work, you note that we are running on Bernaeke fiat money and the ecb has turned on the their printing presses, for an unspecified amount.  fiat money.  weimar II.  worldwide.  by policy.  No one in europe really thinks the super-tarp is going to work. </description>

<description>Leakage.  I understand one reason reason Arizona is feeling peeved is that the border has gotten nicely tight to the west, so there was a big increase in border crossings near Arizona.  I cannot claim any cites, but I am not sure &amp;quot;leakage&amp;quot; is exactly the right word.  Now I doubt that as an abstract issue, anyone thinks a real nation should not have control of its borders.  But if you are a sleazy american employer whose business plan is to hire a lot of whatever is PC to call them, then you might object to border security.  As it happens I would be inclined to put a lot of board of directors and ceo and hr types in the slammer.  And I would simply wipe out the shareholders.  I expect there might be some employer behavior changes.  Another obvious thing to do is industrialize Mexico.  I believe Portillo put the deal together with the Japanese.  Bush vetoed it.  No way a new Japan on our border.  What else?  Well, the drug issue is significant to both countries.  But the banks that illegal handle all this money are by policy untouchable.  Well, that is not quite right.  Books have been written on how a bank should do illegal stuff in a way that maximize profit while leaving the risk acceptable.  An important technique is to structure the bonus money so the line management does the illegal stuff on their own with no paper trail to upper management.   But the feds will always look the other way anyway.  A recent tidbid.  During 2009 there was a bank liquidity crunch.  In a lot of cases, the banks aggressively welcomed the drug money because it was needed to keep the banks open.  But finally, illegals in Arizona are say 5% of the population.  Now I do not think the problem is exactly that they are illegals.   Assume with me,  and not too long ago, 20% of the usa population were despised ill-treated immigrants.  One big wave was the Irish.  Somehow this was not a long-term problem.  So what is the long-term problem now?  The USA, even with the economy real close to completely tubing, should be able to handle this, short and long-term.  In the most simple sense, these used to be Mexicans need to become really American in culture and outlook.  We failed with Obama, but he had some special problems.  </description>

<description>A thought.  Not too long ago we  ran Iraq,  I suppose you would agree we were responsible for the corruption there at that time?  Now they are still very fully a client state of ours.  Some might wonder how much sovereignty they actually have.  For instance, who has the dominate in-country military force?  So, if you would analyze clearly where the responsibility lies, this would be interesting.  Some interesting arguments can be made about brazil and mexico.  and maybe Columbia.  It seems to me that one aspect of the question is precisely as to whether the country is really sovereign. </description>

Cute.  They do have to clean up though.    Most generally, I do not think anyone will really honestly say that burning carbohydrates is the best use of the carbohydrates.  Now if we had been pushing nuclear power the last 40 years, things might look better.  Last I looked Asia had 50 plants building.  USA has one, and it is some old mothballed TVA plant being brought on line after decades of idle.  Europe is a dead zone for progress too, but there was a Russian-Italian deal a few weeks ago. </description>

<description>All this paper that has been propping up the financial system is fake.  Before 1990, it was simply illegal, and now it looks like a lot of is still illegal.  To finish the job the NY AG is starting, we need glass steagall yesterday.  This approach prohibits commercial banks from playing with stocks and derivatives and insurance, even to prohibiting interlocking boards of directors.  And so we look at every commercial bank asset and decide if it is fake or not.  If it is fake, it is gone, worthless as it really is.  And we can figure out if someone needs to go to jail over it.  We got glass-streagall in 1933 from FDR, in the wake of the Pecora Commision.  It keep our commercial banking system safe for what, 60 years.  In 1999, Larry Summers managed to completely wipe the law.  So here we are.  Now Obama, Geither, Summers, Reid, Dodd, all hate Glass-steigall. So even this year a dictatorship is required.  My reading is the population will not tolerate it.  Revolution, or chaos?  So it might be good to do the alternative approach and support McCain Cantwell.  Patriots are turning up in the oddest places.  On the ground, it turns out the rank and file financial district people support this.  Looks like they have a feel for how bad the situation is.  Even some name types.  So, call Wyden.  Make your point clear!  Call Cantwell and give her encouragement. </description>

<description>I saw something funny on gun control.  So, guns are dangerous and if you have one, it will end up being used against you.  So I guess soldiers and marines and paramilitary types carrying weapons are of no value, since their weapons are not going to be able to be useful used by them., but used against them.  Funny deal.  I think the Swizz all pretty much all have immeadiate access to military grade weapons. Its the law!  At least for males.  And I hear that the weapons are not uncommonly seen in public places.  But there does not seem to be much of a problem with misuse.   So if you want to play statistical silliness, I guess we should just hand out AR-!5s on the street corners. </description>

<description>Ugly things do happen, and unfortunately, properly so,  Military caste types do ugly a lot and often are due praise for their actions.  But there is a difference between doing what you have to do and, shall we say, getting off on ugly.  A  couple of you posters seem open to criticism there.  Further, from past viewing of comments, some of you will praise the occurrence of ugly by military caste in pretty much all occasions.  Do you praise an atrocicy?  And doing some ad hominem, seems to be a lot of revenge requirements making the rounds.  Real old testament stuff.  If you are Jewish or Islamic, maybe I should not criticize revenge inclinations, but I keep hearing the USA is a Christian nation and I figure a lot of people validate the New Testiment.  (spell).  and it is a bit of a puzzle. </description>
