They are an opinion of existing law made by a court or judge's. Precedents can often be wrong and have been re-thought as in last years second amendment/Heller decision,which overturned what a majority of judges thought was a precedent in that the Second amendment was a collective right and not an indivudual right. In it's original meaning as the entire Bill of rights are individual God given rights,not given by the Constitution,but restrictions upon the Government. In another example,as in the Fourteenth amendment, court cases have set precedent that the most of the Bill of Rights have been indoctrinated as restrictions on the states also with the exception of the Second Amendment for some silly reason. Sotomoyer believes that there are court cases that have set the precedent that the second amendment can be restricted by the states. This is one of the cases she will most likely be seeing soon.
