It's entirely possible that Hernandez didn't know that the president was away from the oval office. However, that assault could have hurt or killed any number of people who were on the grounds at the time. They could at least peg him with attempted assassination(or murder or whatever) simply due to the fact that he fired his weapon at some place that there might be people.
