Won't all of these gun "transfers" have to go through background checks now? The person manning the tables for the church would according to the law be in possession of illegally transferred/obtained firearms. There is no written in exemption for anything like this. I expect all laws to be enforced.

Colorado requires background checks at gun shows.. There is a huge distinction between a Private Party sale and a Straw Purchase. A Straw Purchase is a deliberate attempt to break the law and put an illegal firearm in a felons hands. If I have a rifle I would like to sell to my best friend that I have known my entire life and I know he is clean because he already has a security clearance working aerospace why should we bother with a background check?

That is not a "Straw Purchase".. once again you do not know what you are talking about. Selling a firearm to another person without a background check is simply a Private Party or FTF (Face To Face) transaction. Even with a FTF it is still illegal to sell to a person that is not allowed to have firearms and it is illegal for a person to buy a firearm if restricted due to a felony and so on. FTF sales are only legal if both people are in the same state, it is illegal to make a FTF sale across state lines (unless the two states have a firearms agreement with each other and this only applies to long guns) or to a person that is not a resident of the same state. Handgun FTF private party sales across state lines are completely illegal period. John Lott did a study years ago and concluded that FTF sales only account for 10% of all gun sales at best and was likely much lower. From "Law Center To Prevent Gun Violence": A “straw purchase” occurs when the actual buyer of a firearm uses another person, a “straw purchaser,” to execute the paperwork necessary to purchase a firearm from a federally licensed firearms dealer (FFL).1 A straw purchaser is a person with a clean background who purchases firearms specifically on behalf of a person prohibited from purchasing a firearm because he or she is a convicted felon, domestic violence misdemeanants, juvenile, mentally ill individual or other federally or state-defined prohibited person.2 The straw purchaser violates federal law by making a false statement to the FFL about a material fact by lying on ATF Form 4473 (the firearm transaction record) or presenting false identification in connection with the purchase

Doesn't take long at all to load a shotgun, if you shoot clays or 3gun or any other shotgun sporting event it takes about a second to put another shell in the tube. He dropped it because he had several other guns as well, this tactic is known as a New York reload.. carry enough guns and who cares about magazines or reloads. The New York reload began with the NYC police Dept. Rather than carry a speed loader for their revolvers they just carried a second or third revolver. When the first was empty just drop it and go to the second.

Where are rocket launchers and grenades legal and where has anyone said they should be? They are not considered small arms, they fall under the category of "destructive device" thus it has been ruled years ago by the Supreme court that they do not pertain to the 2nd Amendment.

What are you talking about? Straw purchases are totally illegal under Federal Law.. I would hope that you know what the law is before you go and say something like a straw purchase is not illegal. http://smartgunlaws.org/straw-purchases-policy-su... All firearms are Federally regulated. Federal law prohibits straw purchases by criminalizing the making of false statements to an FFL about a material fact on ATF Form 4473, or presenting false identification in connection with the firearm purchase. Two federal statutes – 18 U.S.C. § 922(a)(6) and 18 U.S.C. § 924(a)(1)(A) – are the primary laws under which straw purchases are prosecuted.

Unless I am mistaken there still have not been any coroners reports or police reports released for Aurora and NewTown. Both of these lunatics (I refuse to name names while you seem to want to give them the accolade that they desire) had multiple handguns with them as well as a shotgun. I have yet to see anything that specifically lists exactly what was used and how many people were affected. Your blanket statement that 100% of these killings were committed with "high capacity killing machines" is only a guess at best at this moment. I prefer to wait for facts before making such statements. The VT lunatic committed his crime using only handguns with standard capacity magazines. Pretty much all of the wounded at Aurora that I have seen in the news showed signs of shotgun wounds and it has been reported that the rifle jammed early on, still waiting for the report on that one. Looking at the FBI Unified crime report it is easy to determine that over 90% of murders via firearm are committed with ordinary handguns, shotguns and rifles using only a single shot or two. Magazine bans will have no effect on the murder rate.

I shoot rifles recreationally in rifle matches all the time.. I also volunteer and spend much of my time making sure I am treading as lightly as I can on this planet. Where do you get off deciding that anyone that has a firearm is using it for killing? That is absurd and if it was the case with the number of firearms in this country there would be mass bloodshed on every corner.

If politicians were smart they would require everyone to use a 100 round magazine. They are large (hard to hide/conceal), heavy (difficult to move around especially in a confined area) and they frequently jam.. What a great way to end gun crime. There is a reason why the military doesn't use them and that 30 has been picked as the standard when it comes to the AR rifle.

Last I checked, anyone can buy a car, you don't even need a drivers license. You might not be able to drive it off the lot but hey you can still buy it. Yes there are speed limits for those that must buy a car that is capable of 180mph+ just as there are restrictions on how and where you can fire a gun. It is illegal to speed, drink and drive and many other things. Having a couple glasses of wine with your dinner and driving home is akin to shooting a gun randomly into a crowd, you might hit someone you might not. Where is the uproar over drunk drivers and the bars/restaurants that serve alcohol? Lets make it illegal to sell anymore than a single drink to anyone at any time. It is illegal to fire a gun within city limits, certain distances from roadways and structures and it is illegal to simply possess a firearm while committing any type of crime no matter what the circumstances. Our justice system fails on a daily basis when it comes to prosecuting and sentencing people that use guns in crimes. If you are going to ask the question "Why does someone need a certain number capacity magazine?", in order to answer that you must also ask "Why can't someone own a certain number capacity magazine?". There is absolutely no danger to anyone anywhere when a law abiding citizen loads just one more bullet into a gun. Criminals and psychopaths will always be criminals and psychopaths. All of these bills are only a lame attempt to try to stop a crime only after it has already begun, our leaders are only trying to limit the amount of bullets someone can shoot after they have already stepped into a school. All these laws will do is earn them a spot at the dinner table at the next star studded fund raiser in DC and a pat on the back. Our leaders are failing us, what we need to do is stop the crime before it even becomes a seed planted in someones head. We need effective school counselors, expanded mental healthcare and access to mental healthcare and we need to train and educate people on the warning signs so that we can help people before they cross the line. CU had a chance to prevent the Aurora shooting from ever happening and they failed miserably. Public health officials in NewTown had a chance to prevent NewTown from ever happening and they failed miserably. The faculty at Columbine had a chance to prevent Columbine from ever happening and they failed miserably.

How is Virginia Tech any different than the last shooting? Kids trapped in a school room? I'm all ears. Oh yeah, these rifles are banned in Connecticut already so you failed again. So in the end, you are saying all that really matters in this argument is the death of children in a class room and the 500 people that were killed in South Chicago over the last year by handguns don't matter? Does ethnicity have anything to play in your decision? The truth is that these rifles are rarely used in crimes. Yes they are being used more but that has nothing to do with the operation of the rifle or the supposed leathality of the rifle, it is because the AR rifle is becoming one of the most popular rifles on the market. Why is it popular? Because it is customizable. Rather than buying multiple deer rifles for different calibers you just buy a different upper which can be switched out in a few minutes, you can have multiple rifles in one. Rather than going to a gunsmith to have a stock custom fit to you you buy a collapsible stock so that multiple people can use the same rifle simply by extending the stock for larger shooters or collapsing it for smaller people.

"Also as a double edit... it is illegal to go 180mph in any car. See how regulation works?! " Um.. you can drive 180 at a race track just as you can legally shoot a rifle with a 30 round magazine at an organized shooting facility. No you cannot drive 180mph down the road and you cannot shoot a rifle legally in the middle of town. Another bad argument.
