No, the toys aren't actually inside each cracker jack bite. The toy is inside the box sealed in paper wrapping. But I do strongly disagree about the Kinder Surprise eggs being banned. What are we going to ban next, pillows? I know some kids have been suffocated to death by those.

I agree, this is probably torture for that clam. Reminds me of the video with the frog sitting up like it's just chillin' and everyone thought it was cute, when in fact it was stuck in that position; it was essentially paralyzed. It'd be like putting a clamp on a kitten's scruff and hanging it on a flag pole. It's probably not in pain, but definitely in fear. But awwww, how cute. *puke*
