Fandoms and the work they produce themselves exist in a legal grey area.

Even just producing fan content without selling it, and distributing it to the public online can be considered just as illegal.

Fair use covers a lot less than people think. The one big exception that trips people up is parody. Things like College Humor's My Little Brony fall under fair use, while things meant to expand the show and fit in the same style of the show are not (JanAnimations).

The vast majority of the content in the fandom is infringing upon Hasbro's rights, they simply do not act because of the legal grey area and the bad PR it would cause.

Here's an example. What if Google, without Hasbro's permission decided to make their own My Little Pony shorts that defame the mane 6 by making them associated with racism or something. Then they link them on the google home page for free, no profit being made, just for the hell of it. Do you think Hasbro would sit by and allow it? Of course not, it's illegal to distribute content with depictions of characters others own even if you aren't making a profit.

Meh, I just think this whole controversy is bad for the fandom. When you have people out for blood, especially when people are no doubt contacting Hasbro, you bring pressure on the legal department to start taking down fandom stuff.

We become our own worst enemies. I bet the same people who are out for blood right now were upset when Fighting is Magic and Jananimations got C&Ded. Just because this guy's work isn't very good, doesn't mean we should throw him under the bus to await the same fate. It just sets a bad precedence for fan content to continue.

The biggest weapon trolls have is contacting Hasbro. I doubt something like Ask Princess Molestia would have even been taken down if it wasn't for trolls contacting Hasbro.

So yeah, In my opinion EQD was wrong in posting this story, it's just making the fandom turn against itself.

I agree that more people doing it doesn't make it right, but my point is that this controversy is so contrived.

There's so many people making money off of this fandom, illegally profiting from the My Little Pony franchise that Hasbro owns.

I have no idea why people go after this random guy when not calling out every other fandom member who makes money off of their work.

The biggest thing people need to get through their heads is that by making My Little Pony fanart using Hasbro's characters, it is not their own original work, it is derivative. Arguably the only fair use stuff you're going to find is music inspired by the show, crude parodies, and reviews.

Lame apology. He did nothing wrong, he should have just owned it and called people out for not even watching the show.

There's no way that anyone could have mistook his comics for original work. His contribution to the fandom was just changing up the art style and assembling it as a comic, I never saw it as original art (just as anything else using My Little Pony characters isn't an original work). I wasn't a fan of his, but whenever I saw his comics in passing I never considered them to be drawn by him, I just thought they were vectors plopped onto a background with the outlines changed to black.

As for the selling of content, there's no legal difference between selling his stuff vs selling ponies you draw yourself. They're both infringing upon Hasbro's trademarked characters.

I think the issue of making money off the work is a bit silly. Anyone who makes money off of drawing art from the show is infringing copyright by selling derivative work, piggybacking off the success of the My Little Pony franchise for their own gain.

I played around with the AU version for a few hours. It's pretty nice but slows down about 1.5-2 hours in (without friends at least). Just reformatted my ipod and am downloading the US Version. Gameloft id: Highlevelteen

edit: Save file transfers fine (Though I'm not exactly sure how it's stored. I backed up user settings on my ipod before formatting and also had a gameloft id. It'd be nice if it stored it online like Simpsons Tapped Out).

I played about 2.5 hours, it's not bad. It plays exactly like Simpsons Tapped Out and costs over $60 for Princess Celestia in game, pay to win and all. Gameloft id: Highlevelteen
