<description>@ Gad-Fly:  I agree with you....writing in the third person does sound a bit narcisstic.  What you don&amp;#039;t realize is the above was sent out as an electronic news release to keep the media updated.  I use the third person to make it easier for the media to simply copy and paste if they so choose.    I regret that you, personally, don&amp;#039;t have an interest in the above update concerning Schrader.  I pity the fact that you  can only focus on the flaws of an unconventional candidate and not on the bigger issue that is being personified by a flawed candidate.  As Mr. Robinson so eloquently and succinctly put it...this is not about Schrader, this is  about &amp;quot;Allen County Election Board is acting outside of law or regulation. The ACEB has no right to remove Schrader from the ballot. The Allen County Democrat Party has no right to put another candidate on the ballot.&amp;quot; </description>

<description>In the meantime, you can make it more difficult on Schrader by making sure the other legitimate Democratic candidates for city-council at-large run a good campaign.  You can target Schrader and point out all of his flaws....goodness know, you&amp;rsquo;re good at that. (Btw, that was intended as a compliment.)  Goodness knows, Schrader has given you a plethora of things to work with here.  </description>

<description>You see, Kevin, I think in the end, I believe individual members of the ACEB will do the right thing and let voters in November decide if Schrader deserves to be elected or not.  My only hope is that they, the ACEB, do the right thing...because it&amp;rsquo;s the right thing to do.  Individually, I believe that each member of the ACEB is a good, hard-working, ethically-bound individual.  I hope they prove me right! </description>

I just can&amp;rsquo;t fathom they would be willing to risk something like that.....for someone like Schrader. </description>

<description>Regarding Schrader not being on the ballot.....Kevin, first, I don&amp;#039;t believe you have the authority to speak on behalf of the ACEB.  The ACEB may have accepted a Declaration of Nomination from the ACDP asking that Guido be placed on the ballot.  However, the ACEB can not legally place Guido on the ballot until the Court&amp;#039;s create a vacancy.  Doing so is election tampering.  Election tampering has consequences to the ACEB, its individual members and those acting as individual members.  The ACEB was advised of proper procedure by the Indiana Election Commission.  The proper procedure, which is clearly outlined in Title 3 of the Indiana Code,  is known by the ACDP, as contained in their lawsuit of Bynum v Schrader....which, by the way, is a public record that ACEB Lisbeth Borgmann, as Clerk of Courts, has access to and is aware of.  At this point, there is really no way the ACEB can say...&amp;rdquo;We didn&amp;rsquo;t know what the procedure was?&amp;rdquo; </description>

Nonetheless, the Indiana Supreme Court found that the Evrards had established enough intent to establish a voting residence in Perry County to overcome the allegation Evrard had filed false statements about his residency when he registered to vote in Perry County, filed a statement of candidacy and cast a vote in the May primary election.  </description>

<description>In 1970, David Evrard and his wife lived in Virginia where he worked as a patent lawyer for the U.S Department of Justice. Upon learning that the incumbent circuit court judge in Perry County planned to retire, Evrard announced his candidacy and filed paperwork to run in the May primary election for the circuit court judge position as a Democrat. He and his wife began the process of moving back to Perry County; however, it is undisputed that the couple continued to maintain their Virginia residence, Evrard continued to be employed by the federal government, their children continued to attend school in Virginia and the couple both held driver&amp;#039;s licenses issued by the state of Virginia. The Evrards registered to vote at David&amp;#039;s parent&amp;#039;s house until the couple were able to sell their home and move back to Perry County later in the year after he had already won the May primary election and both he and his wife had cast votes in the May primary election. </description>

<description>I believe you are mistakenly relying on the ACEB&amp;rsquo;s interpretation of intent as reference by Zach Klutz, who cited the 1975 Indiana Supreme Court case of Evrard.  Zach used that case to construct the legal theory of intent.  Regretfully, Zach either didn&amp;rsquo;t read the case in its entirety or, in the alternative, hoped that no one else would read the case of Evrard.  The problem with the Evrard case is that, if you compare the facts of this case to the facts of Schrader&amp;rsquo;s case..... it actually helps to make Schrader look good. <description>I will concede that Schrader&amp;rsquo;s only &amp;ldquo;intent&amp;rdquo; was to preserve his right to vote.  Schrader never intended to give up his state residency.  Giving up his state residency would have led to his giving up his state-based residency benefits.  Do you really think Schrader would have given up his benefits?  (Some people might see that as a motive that backs up Schrader&amp;rsquo;s intend to NOT give up his residency.) </description>

<description>Kevin...the reality (that is the act of actually doing something) also trumps intent.    You, or rather the ACEB, have a timeline problem.  Schrader was a clear-cut resident of Fort Wayne since his birth...but for electoral matters, we&amp;rsquo;ll only discuss this residency since his first political candidacy in 1999, which is a dozen years.  Schrader left for about 6 to 7 weeks for a vacation and returned home to Fort Wayne on or about May 11th and has been here since, for nearly 14 weeks.  During the time he was gone, he didn&amp;rsquo;t convert his Indiana ID to a Wisconsin ID, didn&amp;rsquo;t change his mailing address, didn&amp;rsquo;t change his state benefits, etc. </description>

<description>Kevin....Proper procedure trumps intent.  For the sake of argument, you and I could agree that Schrader is ineligible.  Unless Schrader is dead or voluntarily withdraws, he can be ineligible and disqualifiable*.....but the ACEB still can not remove him.  The ACEB can only make a determination...and then the matter goes to Court.  (* By the way, ineligibility and disqualification are two separate and distinct reasons for which someone can eventually be removed from a ballot and each is governed by a separate statute.  Schrader does not meat the criteria for disqualification.) </description>

<description>Given the choice between a flawed, unconventional candidate like Schrader (whose honesty about his whereabouts and the truth about who he is got him booted off the ballot) or a candiate who can be sooooo easily controlled, influenced, and/or manipulated by other like Guido.....well, I think the voters already made their decision known in May&amp;#039;s primary.  Guido should not be given a second shot at November&amp;#039;s elections.  He lost against Schrader, a transient man who did no campaigning and no fundraising.  Besides, the ACDP had a chance to remove Schrader before the primary elections just like the local GOP did when Schrader tried to run as a Republican.  In the end, voters should be permitted to vote for or against Schrader in November because he won fair and square in May and because the judge has not removed him from the ballot, per state law. </description>

<description>Also, lets&amp;#039;s not forget....the candidate the ACDP wants to replace Schrader with is George Guido.  He is a tenant of Kevin Knuths, which permits Kevin to be a huge influencer over Guido&amp;#039;s decisions.  Guido works for the law firm of Carson Boxberger, who&amp;#039;s done a lot of work for Mayor Tom Henry&amp;#039;s office, especially as it pertains to The Harrison project.   </description>

<description>Whatever the reason, Schrader was not disqualified before the primary, the issue of his possible ineligibility was not raised before the primary, and as such he should be permitted to be on the ballot in November....and we all should have a chance to vote for or vote against him. </description>

Or, as some have suggested, it could be that people are soooo tired of politics as usual that they voted for someone who &amp;quot;couldn&amp;#039;t possibly be any worse&amp;quot; than those who already serve.   </description>

He openly admits to being gay, having mental health issues, taking psychotropic medications, being unemployed and relying on Social Security for his existence, living a homeless/transient lifestyle....and this list just goes on and on and on. </description>

<description>Kevin...I think I did tell you my background way before the Schrader matter.  I come from a family where my mother is a second-generation Democratic Union worker (union steward) and my father is a second-generation military man (Army master sergeant).  Really...when you challenge somebody to get involved and that someone comes from the kind of &amp;quot;rules of engagement&amp;quot; background that I&amp;#039;ve come from and has experience in the legal field....what were you thinking would happen?  My dad served in Tikrit, Iraq when those folks got to hold their first democratic election in a generation.  People who ran for office and people who cast their votes were literally risking life and limb.  It sickens me to see how the powers that be here, locally, have twisted this election, essentially making a mockery out of freedom itself.  The folks who proudly serve in our military do so to protect and serve the American way of life and democracy.  Democracy has to be something better than two wolves and one lamb deciding what to eat for dinner. </description>
