It's definitely saddening to see that the judge apparently bought the industry line - hook, line, sinker, rod, copy of angling times...

Also, it will definitely be used as a club to beat other file-sharers with in the future. Although it's a small punishment by many standards, it's still a criminal conviction. They'll use that line to browbeat many into submission - "you could go to jail for this, so just pay up and we'll forget the whole thing..."

It's interesting that smaller, independent content producers are embracing BitTorrent. I wonder what will happen when bittorrent becomes a mainstream distribution platform, especially in light of the report that all Canadian ISP's are limiting P2P traffic on their networks... If the Canadians are doing it, it's increasing likely that other countries' ISP's are too. What's going to happen when the demand for P2P bandwidth is coming from bigger companies, with the resources to tackle the ISP's head on?

Just what I was proposing, although a little broader. Take down as many people as you can - if all the law requires is an allegation, make thousands of allegations - under the law, an allegation is merely an assertion that 'you believe' someone did something wrong, and as such, there is no legal recourse for the person who you accuse (unless you accuse them of doing something genuinely illegal).

Copyright infringement is NOT a criminal offence, even in NZ, and as such, there is no legal recourse if you falsely accuse someone.

Just wait until it becomes law and then send accusing letters to the ISP's of the Police, Medical Establishments, Government Ministers etc - see how long it stays in law then!
