Good lord!! KIMA. Check your facts! That lawyer you interviewed that claims this is fair? He worked for Hagarty - and was promoted by him. What a joke. So much for unbiased reporting.

I am outraged as a citizen of Yakima. The man HITS ANOTHER CAR WHILE DRUNK and then doesn't have any jail time AND gets a reduced sentence?? Only one year of probation opposed to three to five if he got a DUI? And he's the only known ELECTED PROSECUTOR EVER in the state of Washington to be charged while in office? And he gets off?? And don't give me this "everyone deserves a second chance" or "everyone makes mistakes". I fully agree with that in most cases but not when one is in an enormous position of power like Hagarty. He decides who gets charged with crimes and if he wants to ask for life in prison or death. He isn't you or me. He's the top law enforcement official of this county. He has an example to set. I can guarantee that he doesn't offer all first time offenders charged with DUI a reduced charge so how is that fair?

But I do have to say I'm not surprised with all of the good ol' boys around here that he got off. Shame on Hagarty and shame on those out there that think this is a good outcome. Does he even have to do treatment? I doubt it. No wonder we have such utter lawlessness in this community. It's embarrassing. It's truly sad.

They are still up - must be a comp issue on your end. Totally agree though. Lots of drinks it would appear from the reports and the results. They need to get an expert and do retrograde extrapolation in this case especially considering the implications.

Does it matter since Hagarty allegedly caused the accident and then caused Mr. Montes to hit a a van in front of him according to the reports? Are we going to see if that driver might not be legal, too? Mr. Montes had braces on his daughter's teeth! Say what you want but this is a decent man that cares about his kids! He had a well kept, clean home. He wasn't drinking. He actually spoke decent enough English to respond to questions (even though the cops said he didn't speak English - strange) and more importantly call 911 when he got hit and the other driver refused to do so. And I doubt he even told many people, certainly not news folks until THEY CONTACTED HIM. Don't confuse the issues. Hagarty is the one accused of thwarting the law. How can a person who is entrusted, by swearing to God no less to uphold the law get a pass for breaking it WHILE HE IS IN OFFICE?? I realize that a lot of folks in this town have been stopped for drinking and driving and the natural reaction is to give him some leeway but the difference is HE is the one who calls the shots on the prosecution of ALL CRIMES IN THIS COUNTY. If he has a substance abuse problem do you really want him making those important calls? And if he doesn't or claims not to then doesn't that imply he has very poor judgement? It's a no win situation. He needs to resign.

I wholeheartedly agree. I was outraged at the way he treated Mr. Montes. I would again say that I think authorities should consider felony charges because of the accident. The man had to go to the hospital two (2) times so far! Why isn't Hagarty being charged with vehicular assault or second degree assault??. The police reports say Hagarty caused an accident involving three vehicles, not just Mr. Montes' vehicle. Has this happened before with him? Why did he resign from being the Klickitat Co. Prosecutor in 2001? Just seems odd to resign after running for election if there wasn't some kind of controversy.

I would like to see KIMA and the other news organizations request the video from the trooper's vehicle. My understanding is that it is standard procedure for it to be on from the time they are dispatched to the scene to the end of the contact with the suspect. This would include what was going on in the vehicle and whatever conversations took place between law enforcement and the suspect Hagarty. Since there are so many people wondering if he was treated any differently from the average DUI suspect, this would certainly answer that question. But wouldn't it be funny if for some reason they neglected to turn it on? Hope that isn't the case.

This whole things sounds questionable. I remember the paper reported a while ago when there was an allegation of conflict of interest involving a rape case that Hagarty had a cop living with him. It wouldn't be surprising to discover he has plenty of friends in law enforcement.
