She is not technically a farmer. If you advance that argument, the giant federally-subsidized food corporations also own the farms. If on the surface all you need is a contract stating a share, then the government owns farmers land, too. The farmer is the farmer. She's a customer. Plain and simple.

Dan, you are right. What also has not been explained here is that the farmer was not selling the milk to strangers, companies, franchises across state lines, but the person receiving the milk intentionally requested to have that specific type of milk. Not only that, but actually went to the extent of purchasing, in part, a cow for that purpose. The cow was maintained on the farm, and i am sure she contributed towards its upkeep, but she was receiving milk that she actually already owned. As co-owner of the cow, she is entitled to the milk of that cow.

While I disagree with the premise, I can at least see the government's point in protecting me from harm caused by someone else. If, say, an evil farmer calls his milk pasteurized and it's really raw, okay yeah there ought to be some punishment for that. But how in the hell the feds think they have a right to protect me from myself is just completely lost on me. It simply makes no sense whatsoever. If I want to eat Twinkies or drink raw milk or inject heroin into my eyeball while doing the hokey pokey in a fuschia leotard while waching Richard Simmons on TV in my living room, as long as I'm not harming anyone else this is NONE OF THEIR DAMN BUSINESS!!!

People have let the federal government steal their liberties for way too long. My father bought raw milk for as long as he was alive and fed it to all of his children growing up. This raw milk ban is nothing short of control and should be stopped at once, we really need to reform the government and all of the control bullshit.

This article loses all of its credibility when one realizes the author has used two fake quotations. Not intentionally, most likely, but even so that reveals his lack of scholarship. The Benjamin Franklin quote, upon research, is not genuine and was never said by Franklin (you can verify this for yourself by a simple Google search). The Scottish historian Alexander Tytler never even published a book by that name, and the quote is another fake (http://www.lewrockwell.com/north/north484.html). Unfortunately this is all too common in Tenth Amendment Center articles. I've come across numerous scholarly errors in other articles. It's not just a matter of some sloppy research, it's giving people a false view of history that will lead them to believe our Founding Fathers and others said things they patently did not. Do your research, folks.

Ken and M.D. I will second these ideas but the real missing link is A Foundation also known as what I base my decisions on. This has everything to do with a direction, determination and the decision to go this way. What we truly lack is a good sound foundation although I am confused as to why. It is not our Constitution because our Constitution was intended to be Liberty by constricting government to limitations. This was purely done as part of the Declaration of Independence to free ourselves from bad Government and to assure we did not raise another bad Government. The very reason of this failure is not the bankers or the Government but rather the lack of foundation by the people, the public within A Republic which really means Life in support of life by the recognition of our skills and abilities should we investigate and make our determinations on such a solid ground. Do to opposition in our Declaration of Independence even this was obscured and documented truths removed from focus which would have gave us a much clearer picture, a more defined foundation in which to decide from. Surely our main principals reside there as well many of the documented truths that were not removed or altered from their original intent. Today we still don't get it, We the People stands for the people, the public who decide to live as A Republic shall use these principals and these warnings and these instructions to wart off the enemy. Since we have not applied any of these we are left with our mirrors and have no one but ourselves to blame. Not because we are not capable but rather easily swayed by acceptance and what is popular as to not stick out amongst the crowd. This is also cowardly and highly dishonest to ourselves and only hidden from our own lack of review. No one and I mean not one of us can get off by the blame for we are responsible human beings capable of performing that which we decide by putting our minds to work and our focus on and our determination to move forward. Educating each other about what we learn about ourselves becomes the biggest teacher and lesson of all and we can find the best answers to fit such a need. We don't even have to go discover it again because it resided still today in the Declaration of Independence and the finest document ever printed but better yet the original draft does as well and we are capable of putting two and two together. I dare anyone of you to really research this document and dare see what I see. When I located it I could not believe my eyes and still today I am totally blown away by the wealth of information it has given me. Remember this little truth; that no idea existing around you does so without the decision by all those who manifest it, not one. This means we are far more powerful than you think today but if you actually knew with certainty this course would change period.

I was once instructed by a Federal judge that I had to convict on a certain charge while sitting on a jury on a possession case. I kept my peace, but if I had known that I could refuse to convict no matter what I would have hung the jury. It was interesting to see the defense attorney catch the ATF agent in a lie concerning the young man's actions. I refused to convict on the second charge because they wanted that boy to go to jail for 20 years instead of five. At what point did judges begin claiming they could just make up law as they go?

It is pretty evident when you look at the wording that the objects that falls under this clause are states, nations, and indian tribes which are whole groups themselves. It is never any individuals within them so the commerce power is designed to apply to different states, nations, and indian tribes as a whole. It is never citizens of states, nations, or individual members of a tribe.

In general, the American public is less educated now than were the colonists. This has been due to the control the government took over the education in America, to socially engineer drones, workers, obedience to the corporate state. Article I Section IX of the Constitution states: "No Title of Nobility shall be granted by the United States: And no Person holding any Office of Profit or Trust under them, shall, without the Consent of the Congress, accept of any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince or foreign State." This was further enforced by the passage and ratification of the original 13th Amendment which states: "If any citizen of the United States shall accept, claim, receive, or retain any title of nobility or honour, or shall without the consent of Congress, accept and retain any present, pension, office, or emolument of any kind whatever, from any emperor, king, prince, or foreign power, such person shall cease to be a citizen of the United States, and shall be incapable of holding any office of trust or profit under them, or either of them." We the People must act to hold our representatives accountable. We the People must insure that all People are treated equal in all matters of law. And We the People must insist that the Federal government be restricted by the Constitution, and remedy that now! A runaway debt and spending spree will cost us our national sovereignty and our liberty if we don't act now to correct it.
